On June 27th, the Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers formally proposed to repeal the Clean Water Rule, commonly referred to as the Waters of the United States (WOTUS) Rule. The rule, which was finalized in 2015, expanded guidance for the regulation of certain waterways under the Clean Water Act.

The WOTUS repeal would mean returning to 2008 regulations to determine whether a waterway is subject to federal oversight. The agencies’ proposal also calls for re-evaluating and redefining the “waters of the United States” in a new rule.
 
The EPA is expected to publish the proposal in the Federal Register for public comment. Click here for the pre-publication of the new rule and additional information.
